Statement from Commissioner Richardson regarding Association Health
Plans
Carson City, NV – Insurance Commissioner Barbara Richardson issued
the following statement regarding the Department of Labor’s (“DOL”) decision to
appeal but not to seek a stay of the order of the U.S. District Court for the
District of Columbia in New York v. U.S.
Department of Labor, challenging the recent Association Health Plan (AHP)
final rules issued in June 2018.
“The U.S. District Court for the
District of Columbia in New York v. U.S.
Department of Labor found the rules to be unlawful and ordered that certain
provisions be vacated. The Department of Labor did not file a motion to stay;
therefore, the Court’s Order is effective. The Nevada Division of Insurance
will be approaching the Court Order using the U.S. Department of Labor’s stance
while the decision runs through the court appeals process. For any currently approved
Pathway II Association Health Plans, the Division would like to emphasize that under
the DOL’s guidance, the plan cannot add new employer members. Anyone who has
