Statement from Commissioner Richardson regarding U.S. District Court
ruling on Association Health Plans
Carson City, NV – Insurance
Commissioner Barbara Richardson issued the following statement regarding the
recent findings of the U.S. District Court for the District of Columbia in New York v. U.S. Department of Labor,
challenging the recent Association Health Plan (AHP) final rules issued in June
2018.
“New York’s Attorney General challenged the final rules for
AHPs that were issued by the Department of Labor in June 2018. The Court found
the rules to be unlawful and ordered that certain provisions be vacated. While
it is not immediately clear if these findings will be appealed or how the AHP
rule will be enforced in the meantime, the Division will continue to monitor
the matter and will act accordingly once this situation is fully developed. For
