Regulation R087-20
Regulation R087-20 protects consumers against premium increases due to deteriorations in consumer credit information that occurred since the start of the COVID-19 pandemic. The regulation prohibits adverse credit-based re-scoring of consumers based on any changes to consumer credit information which occurred between March 1, 2020, and May 20, 2024. If any policyholder received a premium increase at renewal on or after December 29, 2020, due to a change in that policyholder’s consumer credit report or insurance score, then the insurer is required to issue a refund of that attributed increase to the policyholder. To enable prompt compliance with Regulation R087-20 and the issuance of refunds to any personal-lines consumers who may have already been surcharged, the Property and Casualty Section has issued the Guidance for Insurers and Answers to Frequently Asked Questions: Implementation of Prohibition on Adverse Credit-Based Re-Scoring and Consumer Refunds Pursuant to Regulation R087-20.
